As such, it was recommended that the 1886 Births and Deaths Registration Act be eliminated and the 1969 Births and Deaths Registration Act be renamed the “Births, Deaths, and Marriages Registration Act, 2012.”

You can register your marriage online in most jurisdictions in India, with a few exceptions.   • For a divorcee, you will need an attested/certified copy of the divorce order/decree. For a widow/widower, you will need an attested copy of the spouse’s death certificate.
  • If either partner is of a different religion, the priest who officiated the marriage must provide a document attesting to the conversion.
  • Both parties must sign an affidavit swearing to the truth of their marriage’s location and date, as well as their birth dates and marital statuses at the time of the wedding.

The proposed law seeks to add to the existing domain of family laws. It will not aim to eliminate, abolish, or change specific religious/cultural practices and laws accepted under Indian personal law. The Law Commission’s View on Marriage Registration

The Births, Deaths, and Marriages Registration Act of 1886 only required certain classes of persons to register their births and deaths voluntarily, and for the effective registration of marriages under the Indian Christian Marriages Act, 1872, and the Parsi Marriage and Divorce Act, 1936. However, no law requires that all weddings be recorded to be accessible to anybody in India, regardless of religion or location.
